You are receiving some great advice, although in good faith, some are misleading. We are an Architectural Practice in Chiclana and can concur whole heartily with the advice of Temple Cambria. The majority of the properties in and around El Marquesado (including Pinar de Los Frances) are presently not within an urbanised master plan and therefore properties within these areas are not considered legal in the eyes of the planning authority. In these instances, if the building/structure has been constructed (illegally) more than 6 years without receiving any disciplinary notice/ or demolition order, it then receives the title of 'AFO'. In basic terms 'AFO' means that the planning authority/council/town hall, recognises that the building is an illegal structure (of more than 6 years), but the authority will not request for it to be demolished. Additionally the buildings/structure in question which is considered 'AFO' will also be minimized to a 'preservation and maintenance order' which requires the 'AFO' labelled building not undergo extensions/ alternations our any major material changes. If this was to occur and the council notified, they could issue you with a 'cease to work notice' along with a heavy fine. The only permitted works allowed to 'AFO' buildings are works to 'maintain and preserve' the buildings envelope & aesthetic.
Our recommendation to you, is first appoint a Solicitor whom has knowledge of the area, that can guide you thought the property deeds and legal queries. Additionally I would also suggest that you get a professional visual inspection, such as a (Buildings Conditions Report) to understand the building internal/external and services statues, prior to paying a deposit on the property in question. These type of Visual Inspection & reports can be obtained from a registered Architect or surveyor.
