Good morning Nicole.

You are receiving some great advice, although in good faith, some are misleading. We are an Architectural Practice in Chiclana and can concur whole heartily with the advice of Temple Cambria. The majority of the properties in and around El Marquesado (including Pinar de Los Frances) are presently not within an urbanised master plan and therefore properties within these areas are not considered legal in the eyes of the planning authority. In these instances, if the building/structure has been constructed (illegally) more than 6 years without receiving any disciplinary notice/ or demolition order, it then receives the title of 'AFO'. Asimilado al régimen de Fuera de Ordenación

https://tejadasolicitors.com/buy-property-malaga/afo-certificate-spain/

In basic terms 'AFO' means that the planning authority/council/town hall, recognises that the building is an illegal structure (of more than 6 years), but the authority will not request for it to be demolished. Additionally the buildings/structure in question which is considered 'AFO' will also be minimized to a 'preservation and maintenance order' which requires the 'AFO' labelled building not undergo extensions/ alternations our any major material changes. If this was to occur and the council notified, they could issue you with a 'cease to work notice' along with a heavy fine. The only permitted works allowed to 'AFO' buildings are works to 'maintain and preserve' the buildings envelope & aesthetic.

Our recommendation to you, is first appoint a Solicitor whom has knowledge of the area, that can guide you thought the property deeds and legal queries. Additionally I would also suggest that you get a professional visual inspection, such as a (Buildings Conditions Report) to understand the building internal/external and services statues, prior to paying a deposit on the property in question. These type of Visual Inspection & reports can be obtained from a registered Architect or surveyor.

As a registered Architectural Practice we can assist with the inspection stated above and or any planning queries that you may have relating to the property or the area generally. If you so wish, you can make contact with us on:

[email protected]

I wish you the best with the future search and make sure to take your time in reviewing the information and hire legal representatives to guide you through what can be a tricky process.

All the best,

Adrian

Hi Nicole, we bought our villa in El Marquesado , best thing we ever did, quiet area and friendly neighbourhood. Pinar also has a good range of villas. East 20 minute drive to the beaches  and near to town centre.

If we can assist in any way please let us know.

Chris

Hi Chris.

Also looking at El M. We are mid 60s but fit and usually go to gym, pilates, tennis, cycling and running (5-10k). We have two spoiled cats.  So must have a good vet nearby. Also good doctor (we speak Spanish quite well so doesn't have to be english speaking). Can we find this in the local area?

Hi, choice of 2 vets within  3 km, we have dogs so we use either. Easy distance to numerous  shops and of course bars.  Easy access to ring road  in either direction . There are a few doctors  but not used as yet.

Regards Chris,Sharon.

Hi I bought a place in El Marquesado nearly 21 years ago and I love it here don't  take any notice of these English solicitors they keep trying to implement UK law into the Spanish system,  use a good Spanish one I can recommend  Temple Cambria they are excellent and reasonable with their bills. If I can help at all let me know I can also recommend a very good reliable estate agent. if you need one.
