Hi I am thinking of buying a villa in the Pinar de Los Frances/ Bateria Colorada district. Is this a good area to buy? I am single retired and it would just be me and my little mini dachshund 🙂 Nicole

Make sure the house has proper title deeds and look at the 'nota simple' to see what you can and cannot do in Pinar Frances. When I looked at a house the man had put a second floor on the house without a permit and the 'nota simple' stated that no business could be run from the house, ie: B an B.
Also make sure there is a well and it is functioning if there is no mains water.
Get a good solicitor to check everything out and don't trust the estate agent as they are not responsible for anything.

Hi Nicole, we bought our villa in El Marquesado , best thing we ever did, quiet area and friendly neighbourhood. Pinar also has a good range of villas. East 20 minute drive to the beaches and near to town centre.

Why can't we have a plan or a map of all the suspected areas, that you are likely to find illegal properties.
The areas mentioned are vast I know they are not all illegal in say El Marquesado.so the article makes it sound like it.
With Google Earth it should be relatively easy to circle the hot spots, or are they not known?
Does this mean that even if you use a lawyer that you could still be sold an illegal property?
Don't the Town Hall charge tax on all these villas?

We were advised if the property is mortgage available ,it will be all legal. We were advised to take small mortgage then you have back up. Also a good lawyer will help,many out there.We had no issues in El Marquesado,

If the property tax, ie. Council tax, has not been paid then the new owner is liable for a few past years. As mine hasn’t been paid I negotiated a slight reduction in the purchase price to cover any liability.
Good advise to take out a small mortgage. Remember you are the only one in law who is responsible, not the estate agents, lawyers or accountants. Due diligence is the most important phrase.

Dear Chris,
With all due respect. If your property is in el Marquesado, your property has 99% probabilities of being illegal. I am a lawyer and have dealt with probably more than 200 sales in your area. Only 2 or 3 had planning permission. In those areas you can only make sure the actions to demolish the property have expired to make sure the house is safe, but this does not make them legal. The fact that you did not have issues it does not mean the property is legal. El Marquesado is a place still not urbanised and thus not suitable for building properties for residential purposes. I am not here to get more business (you can bet I have “enough in my plate”). You can hire whoever you like but trying to buy a property in those places without a good (this is the difficult bit!) lawyer checking the documents is like playing the “Russian roulette”. The most likely thing (only around 10 properties have been demolished in El Marquedado and there are thousands) is that you do not have any issues, but if you have the misfortune of buying the wrong one, you could end up appearing in one of those holiday homes from hell programs.
The fact with having a mortgage does not guarantee the property either. There are thousands of illegal properties in Chiclana with a mortgage on it.
I am not trying to scare you here. Chiclana can be a really nice place to live but please do your homework and hire someone really knowledgeable on this issue to avoid risking a good amount of your savings
